Terms and conditions

Last updated:

Draft pending legal review. Details in square brackets are not final yet and the text may change.

These terms govern the use of Ku4ndo (ku4ndo.com and app.ku4ndo.com), an online scheduling and booking service for businesses, operated by Stella JM Corp S.R.L. (cédula jurídica 3-102-786135), with registered address at San José, Costa Rica.

By creating an account or using the dashboard, you accept these terms and the Privacy Policy. If you use Ku4ndo on behalf of a business, you represent that you have the authority to bind it.

1. Definitions

  • “Business”: the person or company that creates an account on Ku4ndo to offer its services and receive bookings.
  • “Dashboard users”: the owner and the people the business gives access to the dashboard (administrators and professionals).
  • “Customers”: the people who book an appointment with a business through its public page.
  • “Public page”: the business’s booking page at ku4ndo.com/business-name or on its own domain.

2. The service

Ku4ndo allows the business to publish its services and opening hours, receive bookings without the customer creating an account, manage the schedule by professional and location, send confirmations and reminders, collect deposits or the full price of an appointment and, depending on the plan, sync calendars, use its own domain and an API.

Ku4ndo is a tool: it does not provide the services the business offers, is not a party to the agreement between the business and its customers, and does not guarantee that the customer will show up or that the business will provide the service.

3. Accounts and access

  • You sign in with an access link sent by email (it expires after 24 hours) or with a Google account. Signing in and creating an account are the same step.
  • To create a business account you must be of legal age and have the legal capacity to enter into contracts.
  • You are responsible for keeping access to your email secure and for the actions of the people you invite to the dashboard. Each plan limits how many dashboard accesses you can have.
  • The information you enter (business name, address, opening hours, prices) must be accurate and up to date.

4. Responsibilities of the business

  • The business is solely responsible for the services it offers, their prices and quality, and for complying with the rules that apply to it (licenses, consumer protection, health, taxes, invoicing its customers).
  • The business sets its own cancellation, rescheduling and deposit refund policies, and must inform its customers of them.
  • The business is the controller of the personal data of its customers that it manages in Ku4ndo: it must have a legal basis to process it, inform customers how it is used and handle their requests for access, rectification or erasure. Ku4ndo processes that data on behalf of the business, as described in the Privacy Policy.
  • Customer notes and tags must not include sensitive data (health, beliefs, origin, etc.) unless the business has a legal basis to process it and needs it to provide its service.
  • The business is responsible for the texts and photos it publishes, for its replies to reviews and for the notifications it chooses to send to its customers.

5. Plans, prices and renewal

  • There is a Free plan at no cost and paid plans (Pro and Business) with more professionals, accesses and features. Current limits and prices are shown on the pricing page and in the dashboard. There is no free trial.
  • Paid plans are charged in advance, monthly or yearly, through Stripe. The yearly plan costs the same as 10 months of the monthly plan.
  • The subscription renews automatically at the end of each period for the same term, unless you cancel it beforehand.
  • The price is charged in a fixed currency per country (no conversion); the currency is set from the business’s first subscription. Prices may or may not include taxes depending on your country: Ku4ndo does not automatically calculate taxes on the subscription.
  • You can change plans from the dashboard. Stripe calculates the proration for the change.
  • If a payment fails, the plan remains active while Stripe retries the charge. If it is ultimately not collected, the account moves to the Free plan.

6. Cancellation and downgrades

  • You can cancel the subscription at any time from the dashboard. The cancellation takes effect at the end of the period already paid, and partial periods are not refunded.
  • When moving to a plan with less capacity (due to cancellation, non-payment or a plan change), you have a 14-day grace period to adjust whatever exceeds the new plan. After that, the newest professionals and services that exceed the plan are automatically deactivated (services become internal-only). Nothing is deleted and appointments already booked are kept, but deactivated items are not reactivated automatically.
  • Features exclusive to the previous plan (for example, custom domain, white label, calendar sync or API) are no longer available.

7. Prepaid WhatsApp and SMS credit

  • From the Pro plan onwards, the business can send notifications by WhatsApp and SMS by buying prepaid credit in fixed packages, through a one-time payment on Stripe. Email notifications do not use credit.
  • Each message is deducted from the credit according to the channel and destination country, at the prices shown in the dashboard. If a message fails to send, the credit is returned.
  • Credit does not expire, is not electronic money and cannot be transferred or exchanged for cash. Credit purchases are not refunded from the dashboard; a refund request is reviewed by writing to [email protected], without prejudice to your statutory rights.
  • If a credit purchase is refunded or disputed after it has been used, the balance becomes negative and sending is paused until it is settled.
  • If the business downgrades to the Free plan, it keeps its credit but cannot use it until it returns to a plan that includes messaging.
  • Only appointment notifications using Ku4ndo templates are sent, and by WhatsApp or SMS only to customers who gave their consent for that phone number. The business cannot use these channels for advertising.

8. Appointment payments with Stripe Connect

  • The business can collect a deposit or the full price of an appointment by connecting its own Stripe account (Stripe Connect). The business is the seller: the charge is made in its name, directly to its Stripe account, and Stripe charges it its fees.
  • Ku4ndo does not charge a commission on those payments, does not receive or hold the money and is not a party to the sale.
  • To connect Stripe, the business accepts Stripe’s terms and is responsible for its account, its chargebacks, its tax obligations and invoicing its customers.
  • Deposit refunds follow the cancellation window configured by the business and shown to the customer when booking: if the customer cancels with that much notice, they receive the refund; if the business cancels, everything is refunded. Any other claim about the payment is resolved between the customer and the business.

9. Acceptable use

You may not use Ku4ndo to:

  • offer illegal or deceptive services, or services that infringe third-party rights;
  • send unsolicited messages, advertising or content unrelated to an appointment;
  • upload personal data without a legal basis or data of people who are not your customers;
  • attempt to access other businesses’ data, circumvent plan limits, overload the service or use the API beyond its limits;
  • post fake reviews or manipulate verified reviews.

Ku4ndo may suspend or restrict an account that breaches these rules, notifying the business where possible.

10. Content and intellectual property

The business retains the rights to its texts, photos, logos and data, and grants us a limited license to host and display them on its public page and in notifications to its customers while it uses the service. The software, the Ku4ndo brand and the design of the service belong to Stella JM Corp S.R.L..

On the plans that show it, the public page includes the credit “Schedule managed with Ku4ndo”.

11. Third-party services

Some features depend on third-party services that the business chooses to connect (Stripe, Google Calendar, Microsoft Outlook, Telegram, WhatsApp, SMS, custom domain). Their use is subject to each provider’s terms, and Ku4ndo is not responsible for their outages or changes.

12. Availability and changes to the service

We work to keep Ku4ndo available and working well, but we do not guarantee an uninterrupted or error-free service. We may carry out maintenance and add, change or remove features. If a change removes an essential paid feature, we will notify you in advance.

13. Liability

To the extent permitted by law, Ku4ndo is not liable for indirect damages, loss of profits, or loss of customers or data caused by the business, nor for the failure to perform the services the business provides. The total liability of Stella JM Corp S.R.L. to the business is limited to the amount the business paid for the service in the 12 months before the claim. Nothing in these terms limits the rights that the law grants to consumers.

14. Closing your account

You can stop using Ku4ndo at any time. Currently, closing a business account is requested by email to [email protected]; beforehand, you can export your customers from the dashboard. Data is kept and deleted as set out in the Privacy Policy.

15. Changes to these terms

We may update these terms. Material changes are notified by email or in the dashboard 30 days in advance. If you continue using Ku4ndo after that date, you accept the new version; if you do not agree, you can cancel your account.

16. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Costa Rica. Any dispute is submitted to the courts of San José, Costa Rica, unless the law of your country entitles you to bring a claim before other courts.
